The bill proposes to require court approval before seized in Massachusetts

Massachusetts Secretary of State William F. Galvin announced his intention to submit a proposal in January legislative proposal to require mortgage lenders across the state to obtain court approval before recovering homeownership through a foreclosure. The bill is clearly intended to allow owners more protection while addressing specific concerns regarding enforcement procedures are performed in reality.

In comparison, Massachusetts and 26 other states, it takes about 90 days for completion of the arrest is made.

In defending his position, Secretary Galvin said he is convinced that effective judicial review would help resolve the uncertainties related to securities, which have many properties in limbo. He added that the process could be accelerated and purpose could be guaranteed.

The bill comes amid growing concerns about the exclusionary practices of service mortgages across the country. Regulators and state attorneys are now looking at the reports from some consumers that the eviction process mortgage banking hastily and without proper judicial oversight.
